EMPLOYMENT CONTRACT
This contract binds
the Employer and Employee to the following conditions and terms:
1. Position :
The Employer
agrees to hire……………………………….(Passport ID#………………………..….)
to fulfill the position of……………………………………….and
the Employee agrees to perform all duties of the mentioned position (see paragraph 4) thereof for the duration of one year.
2. Period of employment:
One
year (12 months) from the date of both parties signing the contract. The contract is renewable upon agreement of both Parties
(Employer and Employee). This contract starts on…………………….…….and
should successfully conclude on……………………... (Unless terminated by either party.
See paragraph 20, and paragraph 23 for resignation, termination, and dismissal conditions).
3. Probation:
Employee
will be on probation (with full pay) for 90 days (Three months). This contract will be terminated if the Employee does not
successfully perform the assigned job description listed in paragraph 4, and or if the teacher caused problems that resulted
in harmful side effects, and or if the employee (or any of his dependants) was arrested for breaking the Thai laws.
4. Teacher’s duties and responsibilities:
A- Provides ESL/EFL scheduled class instructions on assigned sites,
on or off SCLS premises.
B- The instructions should be basic and sub-technical.
C- Articulates clearly, speaks with appropriate speech and steady
rhythm.
D- Refrains from using slang and uncommon idioms.
E- Dominates the class at all times without intimidating the students.
F- Avoids conduction disciplinary actions, of discuss the allowable and accepted types of discipline
with the Supervisor’s permission.
G- Uses only approved Employer supplied teaching materials.
H- The Teacher should discuss any supplementary teaching material with Senior teacher before introducing to students.
I- Develops, administrates, and grades of ESL/EFL written, speaking, and performance tests.
J- Performs as a substitute or remedial ESL/EFL teacher when so assigned.
K- Keeps the senior ESL/EFL teacher or the staff supervisor fully informed of class and individual student’s progress.
L- Assists when needed with students that need special attention.
M- Updates students’ and class records daily.
N- Develops or updates weekly lesson plans.
O- Attends staff meetings during to discuss various methods that may be effective in Class instructions and any other class
related topics.
P- Assists, when so assigned, in revising the existing curriculum, course of study, Visual and Audio teaching aids, Flip
charts, Overhead transparencies, and other related materials.
Q- Provides information concerning a particular teaching method and the procedures involved.
R- Adheres to prescribe metrology and stays alert to all recommended changes through Employer occasional staff meeting.
S- Follows prescribed instructional and administrative policies and procedures.
T- Projects and keeps a professional, friendly, approachable, and cooperative image.
U- Maintains the given accommodation clean and in good condition at all times.
5. Salary:
Salary is bht………….per every teaching hour.
6. Taxes:
The Employer will deduct approximately 10% from each monthly pay for government taxes.
7. Overtime:
Any
number of additional teaching hours that are taught above the mentioned above the teacher’s assigned weekly hours, are
considered Overtime. The Overtime rate is Bht. 20 per hour higher than normal teaching hour rate. Overtime stipend will be
added to the regular pay and will be paid on schedule.
8. Pay
Schedule:
Salary is paid on the 6th of each month. Salary will be paid in Thai baht by deposit to the Siam Commercial
Bank or contact the administration’s pay clerk and collect their pay. If
the pay day is the same date as the holidays or the weekend the pay day will be the next working day. The salary will be paid
after receive the summery of the monthly students marks for the class attendant, homework, ability with the progress of each
students and the lesson plan from 1st of the previous month till 30th
of that month not later than 3 days before the pay day.
9. Escrow:
The
Employer will deduct bht.20,000 as an escrow. This amount will be paid in full at the end of the contract with the last month
pay on the regular pay schedule. Escrow will be forfeited (will not be paid) if:
9.a. The Employee does not successfully complete the full
term of this contract.
9.b. The Employee is dismissed. (See Par. 23)
9.c. The Employee resigns anytime before end of contract.
10. Completion
Bonus:
Not applicable.
11. Work
hours:
The
Employee is required to work five days each week. Teachers’ day off will vary depending on their assigned classes and
teaching load. The Employee cannot switch his or her day off without permission from the Employer. To pass the border can
be processed during the day off and allow 2 working day to process the non-immigrant B visa. Teacher has to inform the Front
desk clerk in advance before your visa will be expired to get the official documents to apply for the visa on time.
12. Dress
Code:
At all times during the term of this contract, males will wear ties and female will wear high cut Dress, dressy
pants and a suit unless otherwise instructed. The height of hemline should not be above the Knees. Casual wear (a Jean skirt,
or a Jean dress) is not acceptable. Teachers should be aware of body odor, the smell, and the look of the clothes. Shorts,
slippers, flip-flops, sandals, tennis shoes, sneakers and jogging shoes are not allowed unless prescribed by a Thai physician.
13. Airfare:
Not
applicable.
14. Local Transportation
In some cases, the assigned teaching site is far from the school, therefore, the Employee will plan to be at school
early enough to be driven to his assigned site. The Employer will provide transportation from the school to the assigned teaching
site. The Employer will not provide transportation to the teacher’s residence.
15. Punctuality:
The Employees are responsible to plan their time to be at school (or at their assigned teaching site) at least
15 minutes before the first class starts. If the Employees always late and miss the classes without approval will be dismissed.
16. Accommodation
The
Employer will assist each Employee to find the in the form of an apartment, or town house.
17. Advance payment:
The Employer will NOT approve advance payment at any time. Therefore, a newly hired teacher must have enough cash
for at least two months before he or she gets paid regularly.
18. Government Health Insurance:
The Employer will provide the option of group health insurance which will be effective when the premium is paid.
The government insurance will be applied for teachers who can apply for the work permit and teacher license, payment will
be deducted from the monthly salary and will be effective after 3 months paying for the insurance premium at for the Labor
Department. He or she can be cured at the chosen hospital for that year and also cover for the unemployment, retirement.
19. Labor Insurance:
Not Applicable.
20. Resignation:
The Employee agrees to inform the Employer at least two months (60 days) in advance of any significant changes
in plan that might have some bearing on the Employee’s period of employment and his/her ability to complete the term
of this contract by formality resigning letter with sign approved from the employer in the letter. Failure to submit the resigning
letter or less than 60 days after approving date, the employee will be treated as dismissal and will not receive one month
pay (min bht.30,000) and the escrow. In case the left amount is not enough, Employee will pay the difference before leaving
the school.
The Employee resigns before complete the contract will loose the escrow.
21. EOC leave:
End of Contract leave between contracts is
only four weeks.
22. Authorized Leave of Absence:
The Employer will grant an authorized leave
of absence if the teacher has a prove that the first-degree family
member has an emergency or, if the teacher
needed surgery with the doctor prescription. Authorized leave
of absence will not exceed three (3) weeks.
Unauthorized leave, Employee have to pay for bht.700 per missing hour of that day according to the
schedule.
If the employee is sick, he has to inform the clerk 1 hours before the first class start that day in
order to arrange the substitute teacher to teach all classes and the employee has to hand the doctor note to the senior teacher
immediately or the latest date to accept the doctor note is not later than 2 days after he can come back to teach.
23. Dismissal:
The Employer and Employee agree that this agreement is fully legal and binding under the Thai laws. The Employer
has the right to terminate this contract at any time (without paying back the escrow) if:
23.1. The Employee
fails the probation period.
23.2.
The Employee has repeatedly missed classes without permission. Employer
has right not to renew the contract or dismissal.
23.3.
The Employee has poor health and cannot perform his or her teaching duties
well and frequently absences. The Employee has been often sick will prove that he or she has poor health which will create
problems for another teachers will be dismissed
23.4.
The Employer discovers that any documents or information provided by the
Employee have been falsified, altered, or deliberately fabricated.
23.5. The Employee’s
behavior is seriously jeopardizing the students or the staff members.
23.6. The Employee’s
has approached (physically or verbally) a student with sexual intention.
23.7. The Employee
has proven to have a drug, or alcohol problem.
23.8 The
Employee has proven to suffer from having personality disorder.
23.9. The
Employee’s class enrollment drops below the average enrollment for the three consecutive months.
23.10.
The Employees has sought forms of outside sources of income without a written
authorization from the Employer.
23.11.
The Employee or any of his/her dependents or guests acts in violation of
the Thai Law.
23.12.
The Employee refuses to accept a new or temporary teaching assignment.
Immediately after the Employee is dismissed and the contracted is terminated
24. Disclosure and abuse of school’s property:
The Employer is not at liberty to utilize school’s property for personal use without permission and is not
allowed to discuss school’s private or sensitive issues with any individuals other than the supervisor.

parts of school property.
25. Teacher’s Code of Ethics:
1. Teacher must not unreasonably restrain the student from independent action in the pursuit of learning.
- Teacher
must not unreasonably deny the student access to varying points of view.
- Teacher
must not deliberately suppress or distort subject matter relevant to the student's progress.
- Teacher
must make reasonable effort to protect the student from conditions harmful to learning or to health and safety.
- Teacher
must not intentionally expose the student to embarrassment or disparagement.
- Teacher
must not, on the basis of race, color, creed, sex, national origin, marital status, political or religious beliefs, family,
social or cultural background, or sexual orientation, unfairly:
- Exclude
any student from participation in any program.
- Deny benefits
to any student.
- Grant any
advantage to any student.
- Approach
a student with verbal or physical sexual intentions.
- Teacher
must have a professional and approachable relationship with students.
- Teacher
must not consume alcohol beverages with students at any time.
26. Dispute:
The appropriate laws of Thailand will govern this Agreement.
Both the Employer and the Employee have read and agreed to all terms and conditions of this contract.
